Use of this web site assumes that you fully accept and agree to the Terms and Conditions set forth in this document (“Terms and Conditions”). When you sign up and create an account on this or any other RewardzNetwork LLC website (collectively, the “Site”), you are becoming a user (“User”, collectively, “Users”). These Terms and Conditions also state that by signing up, you are certifying you have read and understand our Terms and Conditions as well as our Privacy Policy. Furthermore, you are agreeing to the contents and conditions listed in each.
RewardzNetwork LLC (“RewardzNetwork”) reserves the right to change its Terms and Conditions at any time, for any reason, without notice. Please check these Terms and Conditions frequently for changes. Your use of the Site following any such modification constitutes your agreement to follow and be bound by the Terms and Conditions as modified. If you breach any of these Terms and Conditions, your right to use this Site will be terminated.
RewardzNetwork operates two kinds of sites: referral based sites and points based sites. We reserve the right, at our sole discretion, to change the methods through which free items are earned. This may include, but is not limited to, increasing the number of people you have to refer or increasing the number of points you must earn. We may also add or remove any product listed as an incentive at any time. If we replace a product, the new product may not be of equal value. We also reserve the right to discontinue any or all of our web sites at any time without notice or reason. In the event that we discontinue any of our web sites, we will make every reasonable effort to provide sufficient advance notice. Furthermore, in consideration of your use of the Site, you represent that you are of legal age to form a binding contract and are not a person that is barred from using the Site under the laws of the United States or other applicable jurisdiction.
These terms apply to any and all web sites owned and operated by RewardzNetwork LLC.

I. Membership
1. All users must provide accurate and truthful information about their identity to RewardzNetwork, their websites, and their advertisers.
2. Users shall not use another person’s name or information to create an account, meaning you may not sign up for another person.
3. All addresses must be in the following countries: Australia, Belgium, Canada, Denmark, Finland, France, Germany, Greece, Ireland, Italy, Liechtenstein, Luxembourg, Monaco, Netherlands, New Zealand, Norway, Portugal, Spain, Sweden, United Kingdom, United States.
4. Users must be currently living in and be signing up from within the country to which their free gift will be sent.
5. Only 1 (one) account is allowed per household. A household includes your mailing address, and may include your IP address. All accounts with the same shipping address will be placed on hold. There is no guarantee that they will ever be taken off of hold. Be aware that joining a RewardzNetwork site from a shared internet connection such as those available from schools, businesses, or public facilities may result in you having the same IP address as another member and can be considered creating a duplicate account, which may result in your account being placed on hold.
6. One person may not have more then 1 (one) account at each different RewardzNetwork website, even if they provide different shipping addresses. If a person is suspected of having more than one account, all suspicious accounts will be placed on hold. There is no guarantee that they will ever be taken off of hold.
7. Referrals and/or points cannot be transferred or donated from one account to another. Two or more accounts cannot be merged into one account.
8. If your account is placed on hold, you are not permitted to create another account. Any user who is found to create an account when they already have an account that is on hold will be banned from all RewardzNetwork sites.
9. A user may not use another person's name or information to receive products from this website. For example, one person may not join the site for another person, or complete offers for another person's account.
10. Users are responsible for the security of their own account(s). Users cannot share their account information with others and are responsible for keeping their own passwords secure. RewardzNetwork is not liable for any loss due to the theft or misuse of your account of its information.
11. Any unauthorized use, entry, or hacking into any RewardzNetwork site is illegal and is punishable by law. The slightest violation of any law will provide sufficient impetus for us to prosecute the offender to the fullest extent of that law.
12. Ownership of an account may not be transferred to another person.

II. Offers
1. Receiving credit for completing an offer cannot be guaranteed. There is no guarantee that an offer will be credited even if the requirements are fully completed. RewardzNetwork cannot be held responsible when an offer does not credit. You may submit a request for credit, and we will try to give you credit for that offer, but we cannot guarantee that you will receive any form of credit. We reserve the right to deny credit for an offer for any reason.
2. RewardzNetwork cannot be responsible for any delays in reporting of offer completions.
3. Users must complete the offer by using the link provided by RewardzNetwork. If you go to the web site directly, use another affiliates link, or go to the offer site by any means other than through this web site, we reserve the right not to give you credit for that offer.
4. Users are responsible for saving all confirmation e-mails received by affiliate companies. These e-mails might be needed in the case that manual credit for an offer needs to be given.
5. RewardzNetwork is not responsible for the terms and conditions of any of the offer provider web sites or offers on our web site. We are not responsible for any ensuing charges or contracts incurred between yourself and an offer provider. If an offer does not credit, RewardzNetwork is not responsible for any charges made by that advertiser.
6. Users may not complete any offer more than one time. Completing any offer more than one time, even if it is on a different site, is considered fraud and will result in immediate disqualification of your account.

III. Products
1. RewardzNetwork is not responsible for the availability of a product. A product may be from time to time backordered. In this case, we do not guarantee delivery in a timely matter. RewardzNetwork reserves the right to replace any product with a check in the amount of the value of the product.
2. If any account is suspected of false information in order to gain referrals, that account will be placed on hold immediately. There is no guarantee that they will ever be taken off of hold.
3. RewardzNetwork does offer custom gifts on its web sites, meaning that a user can request any gift that can be purchased online. Users are not allowed to request any custom gift that requires buyers to be of a certain legal age.
4. Only one account per shipping address is allowed. If more than one account exists for the same shipping address, all of those accounts will be placed on hold. There is no guarantee that any of the accounts will ever be taken off of hold.
5. We reserve the right to change or remove any free gift offered on any of our web sites at any time. If a free gift is replaced by a different gift, the new gift may not be of equal value to the gift being replaced.
6. RewardzNetwork will only ship free gifts to the address provided in a users account.

IV. Orders
1. RewardzNetwork is not responsible for lost orders due to, but not limited to, incorrect shipping addresses or faults on behalf of the shipping companies.
2. RewardzNetwork does not take returns or exchanges.
3. RewardzNetwork does ship gifts internationally. However, RewardzNetwork reserves the right to require the user to pay extra for shipping to countries outside of the United States.

V. Fraud
1. Any user suspected of fraud, whether it be with the advertisers or not, will be placed on hold. The follow is a list entailing the most common types of offer completion fraud. Please note that this is not a complete list.
(a). Canceling an offer within a few days of signing up
(b). Canceling an offer without trying the service offered
(c). Using fake information for completing offers
(d). Signing up for an offer more than once
(e). Signing up for an offer that you are not interested in
2. Legal action may be pursued if a user is found to have done offers fraudulently.
3. We reserve the right to screen all referrals for signs of fraud. We reserve the right, in our sole discretion, to determine which referrals are fraudulent, and to not disclose the reasoning behind this decision in order to protect our verification methods.

VI. Account Disqualification
1. Common reasons for account disqualification:
(a). Multiple accounts.
(b). Fraudulent referrals.
(c). Negative feedback from any of our affiliates, or offers being immediately canceled.
(d). More than one account at a users shipping address.
(e). Sending your referral link to others in an unsolicited or excessive manner (this includes but is not limited to: email, instant messages or chat rooms) or posting your referral link in newsgroups or online forums where not allowed.
(f). Posting information on a web site, forum, or auction relating to canceling offers, including cancellation phone numbers, cancellation time frames, and any encouragement or direction to cancel the offers after signing up with them.
(g). The use of any software, hardware, service or technique to hide or disguise your identity or IP address is not allowed. This includes the use of any proxy server/service which is not part of your internet service provider. Furthermore, using an internet service provider whose purpose is to provide anonymous internet access is not allowed.
(h). If you join with a computer that others may join from, such as a shared, public, school or work computer, it is very likely that your account will be disqualified due to duplicate accounts. Please understand that this is one way we check for duplicate accounts and cannot afford to make exceptions for multiple accounts created from the same computer or computers sharing the same internet connection/proxy server.
2. Additional Terms of account disqualification:
(a). We reserve the right to disqualify a user's account at any time should they be in violation of any of the terms and conditions outlined in this document.
(b). We are not responsible for notifying a user that his or her account has been disqualified.
(c). If an account is disqualified for any reason, All orders will be cancelled.
(d). If a user feels that he or she has been disqualified due to a mistake or misunderstanding, he or she may contact us via our web site. We do not guarantee any user will be able to get their hold/disqualified status reversed.
(f). We reserve the right to follow up legally on fraudulent activities.
(g). If a user has accounts on more than one RewardzNetwork web site and any of the user's accounts are disqualified due to fraudulent actions, all of the users accounts on all other RewardzNetwork web sites will also be disqualified.
(h). We are not obligated to fully disclose the reasons for a disqualification if doing so may compromise our fraud detection methods.
(i). This agreement may be terminated, for any reason, with or without cause, at any time.

VII. Other Information
1. RewardzNetwork is allowed to place any account on hold for any reason at any time without notice.
2. RewardzNetwork is allowed to deny credit for any offer for any reason at any time without notice.
3. RewardzNetwork is allowed to cancel a users order for any reason at any time without notice.

YOU AGREE TO ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE AND THE CONTENT AND FOR EVALUATING THE ACCURACY, COMPLETENESS AND USEFULNESS OF ALL CONTENT. REWARDZNETWORK MAKES NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER WITH RESPECT TO THE SITE OR THE CONTENT. REWARDZNETWORK EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT WITH REGARD TO THE SITE, THE SERVICES PROVIDED BY REWARDZNETWORK, AND THE CONTENT.
(b) REWARDZNETWORK DOES NOT WARRANT THAT THE FUNCTIONS PERFORMED BY THE SITE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT DEFECTS IN THE SITE WILL BE CORRECTED. REWARDZNETWORK DOES NOT WARRANT THE ACCURACY OR COMPLETENESS OF THE CONTENT, OR THAT ANY ERRORS IN THE CONTENT WILL BE CORRECTED. THE SITE AND THE CONTENT ARE PROVIDED "WITH ALL FAULTS," ON AN "AS IS" AND "AS AVAILABLE" BASIS.

X. Limitation of Liability
(a) TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW, REWARDZNETWORK WILL NOT BE LIABLE FOR ANY LOSS OR DAMAGE ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY USE OR INABILITY TO USE THE SITE OR THE CONTENT. YOU UNDERSTAND AND AGREE THAT UNDER NO CIRCUMSTANCES WILL REWARDZNETWORK BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO: (i) ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE OR THE CONTENT, (ii) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SITE OR THE CONTENT, (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SITE OR THE SERVICE, OR (v) ANY OTHER MATTER RELATING TO THE SITE OR THE CONTENT, EVEN IF REWARDZNETWORK HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

XI. Indemnification.
(a) You understand and agree that you are personally responsible for your behavior on the Site. You agree to indemnify, defend and hold harmless RewardzNetwork, its affiliates, licensors, employees, and agents from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, indirect, incidental, consequential, and/or exemplary damages), and reasonable attorneys’ fees, resulting from or arising out of your use, misuse, or inability to use the Site or the Content, or any violation by you of these Terms and Conditions.

XII. General Provisions.
(a) Every provision of these Terms and Conditions will be construed, to the extent possible, so as to be valid and enforceable. If any provision of these Terms and Conditions so construed is held by a court of competent jurisdiction to be invalid, illegal or otherwise unenforceable, such provision will, to the extent so held, be deemed severed from these Terms and Conditions, and all other provisions will remain in full force and effect. Any and all disputes relating to these Terms and Conditions, the Site, your use thereof, or the Content (collectively, "Disputes") are governed by, and will be interpreted in accordance with, the laws of the state of Virginia, without regard to any conflict of laws provisions. Any Dispute will be venued in a state or federal court situated in the state of Virginia, and you hereby irrevocably submit to the personal jurisdiction of such courts for that purpose.
(b) Entire Agreement/No Waiver. These Terms and Conditions and the Privacy Policy incorporated herein by reference constitute the entire agreement of the parties with respect to the subject matter hereof. No waiver by RewardzNetwork of any breach or default hereunder will be deemed to be a waiver of any preceding or subsequent breach or default.
(c) Correction of Errors and Inaccuracies. The Content may contain typographical errors or other errors or inaccuracies and may not be correct or current. RewardzNetwork reserves the right to correct any errors, inaccuracies or omissions and to change or update the Content at any time without prior notice. RewardzNetwork does not, however, guarantee that any errors, inaccuracies or omissions will be corrected.
